Terms
Last updated: 17 October 2026. Draft pending legal review.
1. Who we are
This website, openingbellalgo.com, and the Opening Bell Algo brand are operated by SBP PROGRAMĂRI S.R.L., a company registered in Romania, Trade Register number J2019001052082, tax identification number (CUI) 40758358 ("Opening Bell Algo", "we", "us"). Registered office: Str. Pârâului nr. 24, bl. E17, sc. B, ap. 3, Brașov, Romania. Contact: see the contact page.
2. What these terms cover
These terms apply to your use of this website. Opening Bell Nasdaq MT5 is available in two ways:
- Direct subscription on this website. The payment is handled by Link (Stripe) as the seller of record, and the licence by us. The subscription terms apply in addition to these terms.
- MQL5 Market, operated by MetaQuotes. Your purchase, payment, licence, activations, refunds and delivery of updates are governed by the MQL5 terms and the MQL5 Market rules, which you accept when you buy or rent on MQL5. If these terms conflict with the MQL5 terms for anything related to an MQL5 purchase, the MQL5 terms apply.
Not offered in the United States
We do not sell the software or the subscription to persons located in the United States or its territories, or to anyone acting for them. This website is open to everyone, but the checkout refuses visitors whose connection comes from the United States, and a purchase with a billing address in the United States is cancelled and refunded and no licence is issued.
By buying, you confirm that you are not located in the United States, that you are not buying for, or on behalf of, a person located there, and that you will not give, resell, transfer or let such a person use the software or the licence. A licence used in breach of this can be ended without refund. If a person in the United States uses the software through a purchase or transfer made by someone else, in breach of these terms, that use is not authorised by us and is the sole responsibility of the buyer and of the user; to the extent permitted by law, we are not liable for it.
3. The software
- We describe the software's behavior and its tested results honestly on this website, but we do not promise any result, profit or level of performance. Trading results depend on the market, your broker and your settings, not only on the software.
- If you are a consumer, you have the legal rights that apply to digital content and digital services in your country (in the European Union, the rules of Directive (EU) 2019/770, in Romania Government Emergency Ordinance 141/2021), including the right to software that works as described and to the updates needed for it to keep doing so. Nothing in these terms limits those rights.
- We fix critical errors free of charge and keep the software compatible with changes of the MQL5 language. Updates are published on both channels at the same time.
- You may use the software only within the licence of the channel you got it from: the subscription licence for the direct edition, or the MQL5 licence for the Market edition. You may not copy, decompile, reverse engineer or redistribute it.
- The CME early-close calendar inside the software is updated once a year. It is your responsibility to keep the software updated.
4. No advice and your responsibility
Nothing on this website is investment advice or a recommendation. You decide whether to use the software, on which account, with which settings and with how much money. You are responsible for monitoring your account and for every trade executed on it. Read the risk disclosure.
5. Information on this website
We try to keep the information on this website accurate and current, including the results we publish. Backtest results are hypothetical and are labelled as such. Information can contain errors or become out of date; if you find an error, please tell us and we will correct it.
6. Limitation of liability
The software executes trading rules that you choose to run on your own account. To the extent permitted by law, we are not liable for trading losses, lost profits, or indirect or consequential losses arising from the use of this website or the software.
This does not limit our liability for damage caused intentionally or by gross negligence, for death or personal injury, or any other liability that cannot be limited by law, and it does not limit your statutory rights as a consumer. If you use the software for business purposes, our total liability is limited to the amount you paid us in the 12 months before the claim.
7. Intellectual property
The texts, charts and design of this website belong to Opening Bell Algo. You may quote short parts with a link to the source. Third-party trademarks mentioned on this website belong to their owners and are used only to describe compatibility and instruments.
8. Changes
We may update these terms. The date at the top shows the latest version.
9. Governing law
These terms are governed by Romanian law. If you are a consumer, this does not take away the protection given to you by the mandatory laws of the country where you live.
Courts. If you are a consumer, you can bring a claim in the courts of the country where you live or in Romania, and we can bring a claim against you only in the courts of the country where you live. For business customers, the courts of Brașov, Romania, have jurisdiction.
Complaints and alternative dispute resolution. Please write to us first; we answer within two working days. Consumers can also contact the Romanian National Authority for Consumer Protection (ANPC) and use its alternative dispute resolution service (SAL) at reclamatiisal.anpc.ro, or the consumer authority of their own country.
